Returns and Refunds Policy

Thank you for shopping at Shape Shift.

If you are not entirely satisfied with your purchase, we're here to help.

Our products can be returned within 15 days of delivery.

To be eligible for a return, please make sure that:

  • The product was delivered in the last 15 days

  • The product isn't used or damaged

  • You obtained a Return Merchandise Number (RMN) from us

Products that do not meet these criteria will not be considered for return.

Products authorized for return must arrive at our facility in exactly the same condition as they were received to be eligible for refund. For refunds, we will issue a refund for the amount you paid for the returned Product(s) minus a 10% restocking fee.

For any products returned with damage, missing items, or signs of use, we have the sole discretion to reject the return or charge a 30% to 65% restocking fee.

You must include your order number from the electronic receipt we email, your RMA number, and a contact email address with your return. Returns that do not include this information and that we cannot associate with a specific order will be disposed of within 60 days of receipt without refund or other liability.

Shipping charges

Shipping charges incurred in connection with the return of a product are non-refundable.

You are responsible for paying the costs of shipping and for the risk of loss of or damage to the product during shipping, both to and from Shape Shift .

Damaged items

If you received a shortage, damaged, or defective product please contact us within the first 48 hours of delivery for assistance.

Sale items

Unfortunately, sale items cannot be refunded. Only regular price items can be refunded.

Warranty

Thank you for your interest in the products and services of Shape Shift.

This Limited Warranty applies to physical goods, and only for physical goods bought from Shape Shift (the "Physical Goods").

What does this limited warranty cover?

This Limited Warranty covers any defects in material or workmanship under normal use during the Warranty Period.

During the Warranty Period, Shape Shift will repair or replace, at no charge, products or parts of a product that proves defective because of improper material or workmanship, under normal use and maintenance.

This Limited Warranty is transferable.

What will we do to correct problems?

Shape Shift will:

  • Replace the Product at no charge, using new or refurbished replacement parts

How long does the coverage last?

The Warranty Period for Physical Goods purchased from Shape Shift is one (1) Year from the date of purchase. This excludes all custom contact poi and tether items, which have a warranty period of sixty (60) days from the date of shipment.

A replacement Physical Good or part assumes the remaining warranty of the original Physical Good or 1 Year from the date of replacement or repair, whichever is longer.

What does this limited warranty not cover?

This Limited Warranty does not cover any problem that is caused by:

  • Conditions, malfunctions or damage not resulting from defects in material or workmanship

  • Conditions, malfunctions or damage resulting from (but not limited to) the following: negligence, misuse, unreasonable use, normal wear and tear, improper maintenance or modification- Damaged or destroyed by natural causes including but not limited to lightning, flood, or other natural disaster- Theft or loss of the Physical Goods

  • Any shipping charges, handling charges, gift wrap fees or taxes You are responsible for and must prepay all shipping charges.

  • Failure to use or store the Product in accordance with instructions furnished by us.

  • We do not service the Flowtoys® capsule light. Please refer to the Flowtoys website and the Capsule Light instruction pamphlet regarding the warranty.  

You shall assume all risk of loss or damage to the Physical Good while in transit to Shape Shift.

What do you have to do?

To obtain warranty service, you must first contact us to determine the problem and the most appropriate solution for you.

Deliver the Physical Goods, in either its original packaging or packaging providing an equal degree of protection, including any accessories or documents that shipped with the Physical Goods to the address specified by Shape Shift.

Implied Warranties

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES (INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.

Limitation of Damages

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, Shape Shift SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.

Consumer Protection

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state to state.

Governing Law

This Limited Warranty shall be governed by the laws of West Virginia, United States without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.
